SYNOPSIS: Despite the numerous EB2 to EB3 downgrades that happened in Q4 of 2020, I still get asked whether it’s safe to downgrade the I-140 from EB2 to EB3. I understand it’s concerning to jeopardize the existing I-140 approval. As such, in this quicktake I explain why I find it to be a relatively low-risk, high-reward case.
